Introduction

Welcome to Heap Chat ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of Heap Chat's software development kit (SDK), web application, and related services (collectively, the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Heap Chat. By using the Service you represent that you meet these requirements.

2. Account Registration

To use certain features of Heap Chat, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately at support@heap.chat if you suspect unauthorized access or use of your account.

3. Use of the Service

You agree to use Heap Chat only for lawful purposes and in compliance with all applicable laws.

• Do not use the Service to transmit unlawful, harmful, or abusive content.
• Do not attempt to disrupt or compromise the security of our systems.
• Do not reverse engineer, decompile, or modify any part of the Service.
• Do not misrepresent your identity or affiliation with another entity.

We reserve the right to suspend or terminate your access if you violate these Terms.

4. Subscription and Payment

Heap Chat is offered free for the first three months for new users. After the trial period, continued access requires a paid subscription.

• The current subscription plan is $20 per month, unless otherwise specified on our website.
• Payments are processed securely through our third-party payment processor.
• Subscriptions automatically renew unless canceled before the next billing cycle.

5. Refund Policy

We provide a 3-month free trial so you can evaluate Heap Chat thoroughly. Because of this trial, once a payment has been made for a subscription period, we do not offer refunds, either full or partial. By subscribing you acknowledge and agree that all payments are final.

6. Intellectual Property

All content, branding, software, and materials provided through Heap Chat are owned by Inspire Dev Studio or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your own business or product use. You may not reproduce, distribute, or create derivative works based on any part of the Service without prior written consent.

7. Data and Privacy

Your use of Heap Chat is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as outlined there.

8. Service Availability and Changes

We aim to provide reliable, continuous access to the Service, but we do not guarantee uninterrupted operation. We may modify, suspend, or discontinue any feature or functionality of the Service at any time without prior notice. We are not liable for any resulting loss or interruption.

9. Limitation of Liability

To the maximum extent permitted by law, Heap Chat and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim related to your use of the Service shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Heap Chat, its founders, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

You may stop using Heap Chat at any time by canceling your subscription. We may suspend or terminate your access if we reasonably believe you have violated these Terms or engaged in fraudulent activity.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.

13. Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. Updated Terms will be posted on this page with a revised "Last updated" date. We encourage you to review these Terms periodically.
